First Amendment principles embodied in Community Access
are enhanced by use of alternative and additional distribution
of Community Access programs by the producers and/or access
stations.
However, 'Fair Use' for classroom,
PEG and Internet is not identical. How many people can see
a program and its immediacy are factors for copying rights.
There is a copyright
interest as soon as there is a 'tangible' medium of expression.
Community Access centers can be subject to contributary
infringement claims; if policies and practices do not inform
citizen producers of rights & responsibilities in developing,
deriving and disseminating content.
